1 Appellant, Adolph Honel Munson, was tried by jury in Custer County District Court, Case No. CRF-84-129, and convicted of First Degree Murder (21 O.S. 1981 ? 701.7 [21-701.7]) (Count I), Kidnapping (21 O.S. 1981 ? 741 [21-741]) (Count II), and Robbery With Firearms (21 O.S. 1981 ? 801 [21-801]) (Count III), before the Honorable Gary McGinn, District Judge. The jury found the murder was committed to avoid a lawful arrest or prosecution, that appellant constituted a continuing threat to society, 21 O.S. 1981 ? 701.12 [21-701.12](5) & (7), and sentenced appellant to death on Count I, ten (10) years on Count II, and forty (40) years on Count III. Judgment and sentence was imposed in accordance with the jurys verdict. We affirm Counts I and II, and reverse Count III.
